NEW YORK (Reuters) - Exxon Mobil briefly overtook Apple as the largest U.S. publicly traded company by market value on Friday as shares of the technology giant continued to fall.

Apple shares traded down 2 percent on the day at $441.31, down from a high above $700 set in September, for a market value of roughly $416 billion. Exxon shares, flat on the day at $91.33, added to a market value of about $416.5 billion.

Apple has closed the day as the largest company by market capitalization since late January last year, when it passed Exxon.

Uresti: 83rd Texas Legislature convenes with an opportunity to build on the future

We're off! But not exactly running.

The 83rd Texas Legislature convened Tuesday amid much pomp and circumstance. The 181 members of the Texas House and Senate took our oath of office, and the House wisely re-elected Joe Straus of San Antonio as speaker.

But the real work of the 140-day session is yet to come. My colleagues and I are anxious to get going, but the Texas constitution forbids a quick start out of the gate. In fact, bills cannot be passed during the first 60 days unless an emergency is declared by the governor.

For now, action on the House and Senate floors will be limited to resolutions and recognitions, and the legislative process will be focused in committees. But as the session moves forward, there will be plenty of time to conduct our business, and there's a lot that needs to be done.

The session began on a much more positive note than the one just two years ago, with Comptroller Susan Combs announcing the state will have $8 billion more than expected for the current biennium and $101.4 billion in general purpose funds for the next two-year spending period. That means lawmakers will be able to pay a $5 billion Medicaid bill left over from the last session and restore funds that were cut from public education in 2011. School funding will be the top priority for me this session, along with additional funding for child abuse prevention programs, and water and roadway infrastructure.

There seems to be a bipartisan consensus emerging to address the state's long-term water needs. As a member of the Natural Resources Committee, and the senator for a good portion of drought-prone West Texas, I support the growing call for spending at least $1 billion from the state's rainy day fund for the State Water Plan - a 50-year blueprint for water infrastructure projects and water use policies that focus on conservation and water quality.

The devastating drought of 2011 and a new dry spell that is taking hold of Texas tell us that the time for action is now. Texas cannot thrive without reliable sources of water for agriculture, industry, and municipalities. We must look to the future and put these forward-looking water-security policies in place.

Another fundamental need, particularly in and around energy-producing counties, is roadway repair and maintenance. I will carry legislation to create a road improvement fund comprised of oil and gas severance taxes and managed by the Texas Department of Transportation.

The resurgence of oil and gas production in South Texas and the Permian Basin has created thousands of jobs and spurred the state and local economies, but all that activity has taken a heavy toll on our roadways, and counties should not have to shoulder the burden of repair costs alone.

The resurging economy and the oil booms have replenished the state's coffers, including the rainy day fund. This gives state lawmakers an incredible opportunity to invest in Texas' future. There may be different visions of exactly what that future holds, but it's hard to imagine that any will be realized if we fail to protect and educate our kids, maintain our state highways and county roads, or ensure a safe, reliable water supply.

The starting gun has fired on the 83rd Legislature. The constitution doesn't let us get off in a sprint, but that's okay. With so much to accomplish, a marathon pace is better to get us where we want to go.

In today?s post, we would like to share China?s collective trademark system with the reader.

I. What is the collective trademark?

A collective trademark refers to a mark applied to in the name of a group, association, or other organization, which is to be used in commercial activities by the members to indicate that they meet the qualification of the organization. The collective trademark is not applied for by a company, but rather a mark applied for by an organization composed of several companies. In some countries, the trademark can be registered by an association of companies acting as an application representative. Sometimes the authority administrating the companies can also make the application. The main function of the collective trademark is to show that the companies using the trademark share common characteristics, explain that they are from the same association, or indicate that the product or service quality meets a unified standard.

II. How to apply for a collective trademark?

Like normal trademarks, applications for collective trademarks are also received and evaluated by the State Trademark Office. Compared to normal applications, however, the following issues must be noted:

1. Applicant

As discussed above, the collective trademark is applied for in the name of a group, association, or other organization. For this reason, the collective trademark?s applicant must be an organization, which can include either commercial or industrial groups. Moreover, it could be an association, industry society, or other collective unit but not a single company or individual business operator.

2. Application materials

Unlike the normal trademark, the collective trademark application requires an examination of whether or not the applicant meets the application requirements. Therefore, additional corresponding materials must be submitted, of which the following documents should be introduced:

(1) Submissions of the management rules or regulations

The Management Rules for Collective Trademark Use (?Rules?) are the rules to be followed by the organization members in the use of the collective trademark, and the Trademark Office must examine whether or not their contents are legal and complete. According to the application manual released on the Trademark Office?s website, the Rules shall include the purpose of the collective trademark use; the name, address, and legal representative of the members of the organization; the quality of the designated product covered by the collective trademark; the process of collective trademark use; rights, obligations, and liabilities for member violation of policy; and the inspection supervision system maintained by the applicant for use of the collective trademark.

(2) The documents for a geographical indicator to be used as a collective trademark

When a geographical indicator is used for the collective trademark, the applicant must also provide the documents showing approval for the geographical indicator granted by the local government or industry authority for the trademark application; the specification of the quality of the product under the geographical indicator, the reputation or other features indicated by the geographical indicator, and other specifications of geographical atmosphere and humanitarian elements of the area covered by the geographical indicator; and objective proof of the existence of the product under the geographical indicator product and its reputation.

III. The collective trademark use method

As to the method of use of the collective trademark, there are many differences compared to normal trademarks, the main difference being:

1. It can only be used by members of the organization

As noted above, the collective trademark belongs to the organization, and for this reason, only the members within the organization have the right to use the trademark. This also means that non-members cannot use the collective trademark.

2. The rights owner must issue the users use certificates

According to the Regulations for Application and Management of Collective and Certified Trademarks (?Regulations?), when using the collective trademark, the applicant shall issue the users a collective trademark use certificate as proof of the right to use the trademark.

3. The rights owner has an obligation to supervise the users? compliance with the quality standards

The organization applying the collective trademark has the right and the obligation to supervise whether or not the users? sale of products and services meet the quality requirements mandated by the Rules. Also, as demanded by the Regulations, when the applicant fails to effectively control and manage the collective trademark, causing the products or services to not meet the requirements of the use management rules and thus damage consumers, the administration may issue a fine. Additionally, by Article 45 of the Trademark Law, the Trademark Office may revoke the trademark right.

4. Use of the collective trademark must obey the Trademark Law and other related laws and regulations

The collective trademark is also a kind of registered trademark; therefore, its use must obey the laws governing normal trademarks, such as not altering or modifying the trademark, or using the trademark to indicate that an inferior quality product is a superior one.

MS Drug Shows Promise in Treating Colorectal Cancer

The study, published online in the journal Cancer Cell, was led by Sarah Spiegel, Ph.D., Mann T. and Sara D. Lowry Chair in Oncology, co-leader of the Cancer Cell Signaling program at VCU Massey Cancer Center and chair of the Biochemistry and Molecular Biology Department at the VCU School of Medicine. Spiegel's team discovered that increased production of an enzyme known as sphingosine kinase 1 (SphK1) causes cells lining the intestine to produce more of a signaling molecule known as sphingosine-1-phosphate (S1P), which activates a variety of biological mechanisms that lead to chronic intestinal inflammation and the development and progression of CAC. The researchers then used animal models to demonstrate that the drug fingolimod decreased expression of SphK1 and S1P's receptor, S1PR1, which subsequently interfered with the development and progression of CAC, even after tumors were established.

"Perhaps the most significant aspect of this study is the therapeutic potential of fingolimod in the treatment of colitis-associated cancer," says Spiegel. "Since this drug is already approved for clinical use, we're hoping to initiate a clinical trial to study its efficacy in patients with CAC in combination with approved therapies."

Essentially, the researchers discovered a self-feeding loop that results in chronic intestinal inflammation and increases the progression of CAC. The team showed that increased production of SphK1 and S1P lead to sustained activation of NF-kB and Stat3, which are both proteins called transcription factors that control the way DNA is transcribed in a cell's nucleus in order to respond to environmental stimuli. This increased activation of NF-kB and Stat3 led to an increased production of TNF-a and IL-6, which are small pro-inflammatory molecules secreted by immune system cells. The increased inflammation, in turn, led to increased production of SphK1 and S1P, which continued the malicious cycle.

This is the first time that SphK1 and S1P have been linked to NF-kB, Stat3, chronic inflammation and CAC.

"Because one of the consequences of inflammatory bowel diseases is an increased risk of developing colorectal cancer, the next step in our research is to examine blood samples from patients with irritable bowel syndrome and colitis-associated cancer to measure levels of S1P," says Spiegel. "Colorectal cancer is one of the leading causes of cancer-related deaths, and we're hopeful that this research will lead to more effective treatments."

Florida car accident insurance was already confusing. Now, with the changes to Florida's No-Fault Personal Injury Protection (PIP) coverage, it is even more confusing.

In a previous article, I discussed the importance of seeing a doctor within 14 days of your accident. If you fail to see a medical provider within 14 days, you are not entitled to any of the $10,000 Personal Injury Protection (PIP) coverage you contracted for. However, satisfying that requirement does not guarantee that you get all your benefits.

Now, the law requires that you must be diagnosed with an "emergency medical condition" in order to be entitled to the $10,000 in PIP benefits you paid for. Florida Statute 627.732(16) defines an emergency medical condition as a medical condition manifesting itself by acute symptoms of sufficient severity, which may include severe pain. Without seeking immediate medical attention, your medical condition could result in any of the following:

• Serious jeopardy to your health;
• Serious impairment to bodily functions;
• Serious dysfunction of any bodily organ or part.

If the appropriate health-care professional determines that you suffered from an emergency medical condition, then you can receive reimbursement for all medical services and care up to your $10,000 PIP limit. If, instead, you're found to have a non-emergency medical condition, then your PIP benefits are limited to only $2,500-even though you contracted for $10,000 in PIP benefits.

It is important to know who can determine if a person's condition is, in fact, an emergency medical condition. The law prohibits chiropractors from making this determination (albeit, they have hands-on knowledge of their patient's condition). The law states that medical doctors, osteopaths, physician assistants, nurse practitioners, podiatrist and even dentists can make this diagnosis. Without it, an injured person is limited to $2,500 in PIP benefits.

This change will like prompt much litigation--the treating doctor will opine that the patient has an emergency medical condition while the hired-gun insurance doctor will conclude otherwise in hopes of restricting the insured's benefits to $2,500.00.

It is important that if you or a friend or family member is involved in a Florida automobile accident, they need to talk to an attorney who understands this new law immediately after the crash. Waiting too long can risk the benefits they are entitled to.

When an Old Metairie house caught fire during Hurricane Gustav, it fell to a 75-year-old woman who lived next door and Sheriff Newell Normand to fight it -- with garden hoses -- according to newly released records in a lawsuit over the 2008 incident. Jefferson Parish?firefighters were hunkered down in storm shelters, forbidden to respond by a policy suspending emergency services during the storm.

About an hour after the first 911 call, firefighters finally rolled out and extinguished the flames. But by then the rented home of Garrett and Monica Haab was destroyed.

The Haabs say Jefferson Parish poorly executed a flawed policy designed to safeguard its emergency responders during dangerous winds. The parish ignored milder conditions on the scene, rebuffed pleas for help from neighbors, Normand and a former fire chief and "nearly caused all of Old Metairie to go ablaze, which would have killed many people," the couple says.

Normand clearly thought the situation was absurd. A phone recording captured him directing a subordinate to call the fire chief, and spluttering: "I'm sitting out here with a motherf---king" garden hose."

As it turned out, no one was injured in the blaze, and it didn't spread beyond the Haab home at 412 Dorrington Blvd. But the dispute over whether the East Bank Consolidated Fire Department should have responded earlier continues to flare in court, where the Haabs are testing a state law that gives parish presidents extraordinary authority -- and shields the government from liability - during officially declared emergencies.

Jefferson Parish says it is immune from blame. It has asked Judge Conn Regan of the 24th Judicial District Court to dismiss the suit, asserting that the Louisiana Homeland Security and Emergency Assistance Disaster Act protects it; that both Gov. Bobby Jindal and then-Parish President Aaron Broussard had declared emergencies; and that residents were ordered to evacuate and warned to expect no services. The Haabs, in fact, did leave the state.

"The decisions by the parish in this case were made to protect the safety and lives (of) firefighters during a hurricane event, which is a legitimate government objective grounded in social policy," Jefferson's legal counsel, Craig Watson, wrote in his motion.

In rebuttal, the Haabs' attorney, John Venezia, on Monday filed a 28-page motion and 30 exhibits, including affidavits and depositions from Normand; then-Fire Chief Dave Saunders; former Fire Chief Dan Civello; and the Haabs' next-door neighbor, Edward Martin, a physician whose family called 911 on Sept. 1, 2008. Flames erupted about 8:30 a.m. when a tree branch struck the electrical panel on the Haab house, but the Martins "were told no fire services were coming and that they should have evacuated," Venezia's motion says.

"Dr. Martin and his family went outside and felt that the wind was not blowing hard. Even Dr. Martin's 75-year-old mother could stand outside safely. ... These lay people tried to stop the fire from spreading, spraying water with garden hoses on Dr. Martin's home. Even the 75-year-old woman participated. They continued to call 911 ... without success."

Civello, a 30-year firefighter who was East Bank Consolidated's chief from 1986 to 1997, drove over from his house about two blocks away. An elected constable, he also called 911, saying the entire block was at risk. Normand and then-U.S. Attorney Jim Letten, who each live about a mile away, also showed up, as did sheriff's deputies.

As instructed, firefighters were sheltered at Ochsner Medical Center and East Jefferson General Hospital. But two of them "heard about the fire over the radio, disobeyed orders, stole an ambulance ... and came to the scene to help," according to Venezia's motion.

An audio recording from the parish's 911 communications center relates this exchange between the sheriff and Major Rick Moore.

Moore: "The Fire Department's dispatchers are saying that they are not sending any units over there. ... I'm sorry."
Normand: "They not, they not. So what: I'm gonna lose the whole f---ing block?"
Moore: "That's what they're telling me. Uh, they haven't heard from Saunders to do anything otherwise, but they're not rolling on it."
Normand: "Somebody needs to get f---king Dave Saunders on the phone!"
Moore: "OK."
Normand: "Dan Civello is sitting here right next to me saying this is a f---king joke."
Moore: "I can't believe it either."
Normand: "I mean, you know, it's ridiculous."
Moore: "You want us ... "
Normand: "I'm sitting out here with a motherf---king" garden hose."
Moore: "Jesus Christ! Let me see what I can do."

All Fire Department dispatching had ceased about three hours earlier, at 5:33 a.m., due to tropical storm-force winds. It wasn't until 11:18 a.m. that Emergency Management Director Ken Padgett lifted the order, according to the parish's records.

But just before 9 a.m., Saunders talked with his boss, then-Homeland Security Director Deano Bonano, and both drove over to investigate the Dorrington Boulevard fire. Bonano joined the garden-hose brigade, and Saunders summoned the first fire truck, which showed up at 9:43 a.m.

Firefighters eventually doused the fire, finally leaving at 11:42 a.m. Venezia estimates the "hard value" of the Haabs' losses at $400,000. That doesn't include sentimental value of items such as family pictures and Monica Haab's wedding dress.

Venezia argues that the suit should go to trial. While parish policy called for firefighters to remain sheltered when sustained winds exceeded 50 miles per hour, he suggests that Jefferson's anemometers - devices that measure wind speed, three of which failed on the day of the storm - were poorly positioned and were measuring gusts, not sustained wind. He asserts that the actual sustained wind speed at the time of the fire was as low as 25 mph.

And he says the state's emergency authority law doesn't protect the government for "acts or omissions which constitute criminal, fraudulent, malicious, intentional, willful, outrageous, reckless or flagrant misconduct." Civello signed an affidavit opining that five of those adjectives apply to the Fire Department's refusal to respond.

Three weeks after the fire, parish officials began revising their procedures, allowing individual fire chiefs to override the sheltering policy even when winds exceed 50 mph, according to Bonano's deposition.

Judge Regan has scheduled a March 12 hearing to determine whether to dismiss the suit.

ALISO VIEJO, Calif. (January 8, 2013) ? The Surf Industry Manufacturers Association (SIMA) launches the 2012 SIMA Specialty Retail Distribution Study, the fifth of its kind, next week and retailer participation is crucial.

Specialty retailers can expect to begin receiving telephone calls the week of January 14 from the Leisure Trends Group (LTG), a full-service consumer research and consulting company, on behalf of SIMA asking for their participation in the study. Calls will be made through mid-February, and specialty surf and skate retailers will be selected at random to participate. Survey calls should last approximately 15 minutes, and retailers can request to set an appointment/call-back time allowing the phone survey to be completed at their convenience. All participating retailers and SIMA members will receive a free copy of the study results when released (a $5,000 value).

1. Footwear: The overall footwear category (men?s and women?s shoes and sandals) generated the greatest sales in 2010 with $1.5 billion? ? an increase of 8.2% from 2008.

2. Stand up Paddleboard (SUP): As an emerging trend, 2010 was the first year the SIMA Retail Distribution Study has tracked the sales of SUPs. SUPs accounted for 9% of total surfboard sales generating $14.5 million. The average SUP cost $1,105 making it the highest costing product in the study.

3. Wetsuits: Wetsuit sales increased to $110.4 million in 2010 (24.5% over 2008). Fullsuits continued to drive wetsuit sales. An average of 139 full wetsuits were sold per store at an average price of $217.

4. Hard Goods: This product category including surfboards, skateboards and other hard good accessories increased by 35% to $1.46 billion in 2010. For the first time, the study indicates that surfboard hard good accessories including surfboard leashes and surfboard traction pads accounted for 5% of these sales, generating $73 million.

Do Sellers sell their houses to get SOME of the money possible from the sale?

No.

Sellers want ALL the money possible from the sale ? the BEST PRICE possible so they can maximize the profit from the sale of their house. Not just SOME of the money possible.

Realtors want to earn as much commission as possible from the sale of a house for all their hard work ? at least the ones that are serious about having a successful real estate business. And the fact is a Realtor has a fiduciary responsibility to get their clients the MOST from the sale of their house ? not just some of the potential money. ALL of it.

Imagine if Sellers understood the difference between List Price and STAGED List Price. Wouldn?t ALL of them want to Stage before Listing?

What is the List Price? That is the price the listing agent believes is a fair price for the house based on a comparative or competitive market analysis (CMA). They take a look at recent solds in the neighborhood that are comparable to the current house being listed for sale, and then they factor in the market. Is it going up? Is it a declining market? And they come up with a price RANGE for the house.

A Realtor does not want to price the house too high ? because then they are ?chasing? the market for the sale and Buyers always want ?a good deal? on a house they buy.

That is where Staging comes in.

What is the STAGED List Price? That is the price the listing agent believes the house will sell based on the CMA, the marketed competition AND the fact that the house outshines 85-90% of the other listings. In a hot market, it is often a higher starting point that just the list price. Because the house outshines the competition, it becomes the ?benchmark? for all other properties the buyer is looking at, and ultimately becomes the one they must have. Because Staged houses sell faster than their un-Staged competition, in a slower market they are less likely to experience a price reduction therefore they do sell at a better price than their competition.

A Staged house shows better than the competition and creates this feeling within that makes a Buyer want to buy THAT house. The Staged house feels more spacious, warm, inviting, clean, and easy for a Buyer to envision living inside ? and it gets the offer. Statistics all over the country prove that a Staged house sells faster, and for MORE than the un-Staged competition. In a hot market, this can translate into possibly multiple offers.

Now, Staging is not a magic wand that would allow a Seller to demand ANY price for their house ? they must still be reasonable and with their Realtor?s guidance price the house within the range of where it will sell. But they don?t have to be at the bottom of the range, or even in the middle when the Staging has included updating such as new carpeting, painting, fixtures, and flooring. They can be towards the top of the range which in many markets means thousands of dollars more for the sale of the house.

For certain a Seller needs to honestly assess their house compared to their competition ? and take note of how their house looks compared to others ? that might be Staged ? because if they choose not to Stage, their house will be ?used? to sell the Staged houses.

Did you know that in the Denver area only about 10-15% of the houses are Staged prior to coming on the market? This gives YOUR listing or house an immediate advantage over 85-90% of the marketed competition! Around the country some areas have 50% of the houses being Staged while others are hard pressed to find even 5%.

A Staging Consultation in the Denver area ranges between $125-$350 and the consultation should include a detailed plan for the Seller on what they can do to get their house Staged and show ready. This is a MINIMAL investment compared to the ability to position their house at a better price than the un-Staged competition. Nationwide, the consultations range from $125-$450 depending on where you live and it?s all relative to the market and median price for houses.

Dare I say that the Consultation by a trained Professional Stager one that every Realtor should be using as part of their listing process? Yes.

In fact, the Realtors I have worked with over the years that include Staging as a standard part of their listing process, paying for this service for their clients to ensure it gets done, are the TOP agents in the market. They understand that it?s not worth listing a house unless the house puts its best foot forward ? and makes the right first impression.

If you are listing your house ? you as the Seller need to take control and make sure your house is STAGED prior to coming on the market and pay for the consultation if your agent does not include it. Get a trained Professional Stager to advise you on what you need to do. Or list your house with a Realtor that includes a 3rd party Staging assessment as part of their listing and marketing services.

The STAGED List Price in some market can be $10,000-$50,000 MORE than just the ?list price? ? and buyers will make an offer on the house that is ready for them to move in, is clean, decluttered, does not smell bad, feels spacious, updated, looks fresh and inviting.

The alternative is to not Stage, and just price your house where you hope it sells, and then reduce the price if there is no activity. That price reduction is usually 10-20 TIMES the Staging investment. That leaves a LOT of money on the table!

You see, you don?t SAVE by not Staging ? you either invest it up front or you lose it on the back end with a lower starting point or price reduction(s).

New stem cell approach for blindness successful in mice

Jan. 7, 2013 ? Blind mice can see again, after Oxford University researchers transplanted developing cells into their eyes and found they could re-form the entire light-sensitive layer of the retina.

Videos show the nocturnal mice, which once didn't notice the difference between light and dark at all, now run from the light and prefer to be in the dark -- just like mice with normal vision.

The researchers say the approach has relevance for treating patients with retinitis pigmentosa, a condition in which the light-sensing cells in the retina gradually die leading to progressive blindness.

The study was led by Professor Robert MacLaren in the Nuffield Department of Clinical Neurosciences at the University of Oxford, together with Dr Mandeep Singh, an eye surgeon from the National University Hospital of Singapore who is currently undertaking PhD studies in Oxford. The findings are published online in the Proceedings of the National Academy of Sciences.

The researchers worked with mice that are blind due to complete loss of the light-sensing photoreceptor cells in their retinas. This is the most relevant mouse model for treating patients who are blind from retinitis pigmentosa.

After two weeks, the researchers showed the cells transplanted into the eye had re-formed a full light-detecting layer on the retina and the mice could see.

The cells used were mouse 'precursor' cells that are on an initial path towards developing into retinal cells.

A pupil constriction test showed that, of the 12 mice that received the cell transplant, 10 showed improved pupil constriction in response to light. This shows that the retinas of the mice were sensing the light once more, and this was being transmitted down the optic nerve to the brain.

Dr Singh says: 'We found that if enough cells are transplanted together, they not only become light sensing but they also regenerate the connections required for meaningful vision.'

Professor MacLaren explains: 'Stem cells have been trialled in patients to replace the pigmented lining of the retina, but this new research shows that the light-sensing layer might also be replaced in a similar way. The light-sensing cells have a highly complex structure and we observed that they can resume function as a layer and restore connections after transplantation into the completely blind retina.'

In looking forward towards potential cell treatments for blindness in humans, Professor MacLaren explains that they would like to use induced pluripotent stem cells, or iPS cells. These are stem cells that have been generated from the patient's own cells, such as skin or blood cells, and can then be directed to form precursors of the retina cells.

Professor MacLaren says that this has been achieved by others: 'All the steps are there for doing this in patients in the future.' The next step is to find a reliable source of cells in patients that can provide the stem cells for use in such transplants, he says.

While these are more long-term developments to work towards, Professor MacLaren says 'Our study shows what we could achieve with a cell-based approach.'

'We have shown the transplanted cells survive, they become light-sensitive, and they connect and reform the wiring to the rest of the retina to restore vision,' he says. 'The ability to reconstruct the entire light sensitive layer of the retina using cell transplantation is the ultimate goal of the stem cell treatments for blindness we are all working towards.'

NEW YORK (AP) ? There's heartbreak ahead for some "General Hospital" fans.

Steve Burton, who played Jason Morgan on the ABC soap opera for nearly 21 years and left the show last fall to relocate his family to Tennessee, is joining the cast of "The Young and the Restless."

Burton made the announcement Monday on CBS' "The Talk."

He said in an interview with The Associated Press that the opportunity came from a recent developing relationship with Sony Corp. where he and actor James Franco (and former recurring "General Hospital" guest star) have been trying to develop a prime-time series.

"They asked if I was ready to come back to daytime and ... what could they do to make that work," said Burton. He said he wanted his family to stay in Tennessee and he needed a flexible schedule to spend time with them.

"I get to have the best of both worlds and fly back and forth" from Los Angeles, he said. "I wasn't really expecting it."

On "Y&R," Burton will play Dylan McAvoy, an ex-soldier with a secret.

The 42-year-old begins shooting Tuesday. His first episode is slated to air Jan. 29.

"It is a little nerve-racking because I don't really know who the character is. The cool thing is I know a lot of people who are there already. The soap world is a small world," he said.

Another appeal for Burton is that former "General Hospital" executive producer Jill Phelps is now at the helm at CBS' "Y&R," which has ranked as the No. 1 daytime drama for almost 25 years.

Burton understands some of his fans who may have been hoping he would return to "General Hospital," will be disappointed that he's joining "Y&R," but says it was time to do something different.

"To play a character for that long is amazing, but as an actor you want to do something new," he said. "I get to play a whole new character and a whole different life."

One thing he's not sure will change is the name of his band, Port Chuck, made up of "General Hospital" actors Scott Reeves, Brandon Barash and Bradford Anderson. The name is a play on the name Port Charles, the fictional setting of the soap opera.

Will the band need to incorporate Genoa City, where "The Young and the Restless" takes place?

"Most people who don't know us anyway are like 'Pork Chop? What the heck is Port Chop? No, Port Chuck!' As of now there are no plans to change the name," he said.

AURORA, Colo. (AP) ? SWAT officers who stormed a Colorado home where a gunman had holed up found a horrific scene ? four dead bodies including that of the gunman.

Police said the armed man fired shots at officers Saturday from a second-story window before officers killed him. Once inside, they found the bodies of three other adults.

The suspect, whose name was withheld by police, held officers at bay for nearly six hours after neighbors reported gunfire at 3 a.m. inside the modest townhome in the Denver suburb of Aurora, said police Sgt. Cassidee Carlson.

It wasn't known if officers shot the suspect or if he shot himself.

Investigators said two men and a woman appeared to have been killed before officers arrived.

The suspect shot at police who approached the front of the home with an armored vehicle and who fired tear gas around 8:15 a.m. He was killed when he fired at officers from the second-story window about 45 minutes later, Carlson said.

"After we arrived on scene, there were no more shots fired up until he fired at us," Carlson said. "During this time he was all over the house. He moved furniture. He was throwing things. He was agitated. He was irrational."

A large front window was missing in the two-story townhome, the window's mini-blinds in disarray. Bullet holes marked two upstairs windows, and neighbors milled about outside.

A fifth person escaped unharmed and called police to report that she saw three people inside the home who "appeared lifeless," said Carlson, who declined to elaborate about the woman's escape.

A motive for the killings was unknown, and police had yet to say what weapon or weapons were used. Investigators wearing gloves and carrying evidence bags were going over the crime scene.

Police declined to release the victims' names.

"We have an idea of who they are, but we obviously want to confirm their identities with the coroner," said Carlson, who declined to release the relationship between the victims and the shooter.

Officers evacuated neighbors' homes during the standoff and used a bullhorn to communicate with the gunman, urging him to surrender.

Next-door neighbor Melissa Wright, a nurse who treated victims of the July movie theater shootings in Aurora, said she was in her second-floor bedroom when she saw the gunman start shooting from his own bedroom window. She said she didn't know what he was shooting at, and that she quickly dropped to the floor.

"I hit the ground pretty fast," Wright said.

Wright said she slid on her belly to the first floor of her home and told police what she saw upstairs. Officers quickly entered her home.

Wright said she knew the gunman as Sonny Archuleta ? a name used by police officers trying to negotiate with the man with the bullhorn. Wright said the townhome may have been inhabited by the gunman, the gunman's wife, her father and another man.

The shootings occurred about four miles southeast of the Aurora Mall, where 12 people were killed and dozens were wounded by a gunman at a midnight showing of "The Dark Knight Rises" on July 20. The man charged in that shooting, James Holmes, goes to court Monday for a preliminary hearing in which prosecutors will present their case against him.

The July shootings prompted Gov. John Hickenlooper ? just before the Newtown, Conn., massacre ? to say it is time to debate gun control. It's expected to be a heated topic at the Colorado Legislature this year.

Aurora, just east of Denver, is one of Colorado's largest and most diverse cities with more than 335,000 residents. It is home to Buckley Air Force Base as well as the sprawling University of Colorado Health Sciences Center campus, where James Holmes studied neuroscience before the movie theater shootings.
