?One of the concerns after Steve Jobs died was whether Apple?s institutional values ? as embodied by his hand-picked executive team ? would survive his passing,? Philip Elmer-DeWitt writes for Fortune. ?The team lost a key member when Ron Johnson, who built the Apple Stores, departed in November run J.C. Penney. Because Johnson made his decision to leave public nine months before Jobs died, that didn?t seem to count.?
P.E.D. writes, ?But when Apple announced in a news release Thursday night that senior vice president for hardware engineering Bob Mansfield was retiring, the tech press took notice? Apple?s press release doesn?t provide Mansfield?s age, but he looks pretty young for a retiree. We?ve seen no evidence that he was forced out. Perhaps the burden of supervising so many important products finally took their toll.?
?Mansfield can certainly afford to retire,? P.E.D. writes. ?Between August 2008 and March 2012, according to MarketWatch?s insider trading log, he sold Apple shares worth nearly $98 million (some of them to pay taxes). According to his latest SEC filing, he still holds 120,000 shares worth, as of Thursday?s close, another $68 million. Other members of Apple?s executive team are just as rich ? if not richer. That?s one of the downsides of rewarding employees of a successful company with stock options. Keeping those multimillionaires ? and their institutional memory ? around will be one of Tim Cook?s great challenges.?

I was worth over $1,000,000 when I was 23, and over $10,000,000 when I was 24, and over $100,000,000 when I was 25, and it wasn?t that important because I never did it for the money.
Now ? and we?re not talking about Mansfield or Johnson here ? if your goal is to get rich and cash out, Apple doesn?t want you. It?s not a ?great challenge? for Tim Cook, it?s self-selected winnowing. Cook just needs to make sure the wheat is ready as the chaff blows away.

In today?s market, most financial services firms have a Chief Risk Officer or even more specifically a Head of Operational Risk. Few would argue that these roles exist as a means to solely satisfy regulators.
These roles are critical to protecting a firm?s earnings and reputation. In addition, many have found that having a solid operational risk strategy can deliver significant additional benefits.
Despite the importance of these roles, the day to day responsibility for operational risk does not lie with the CRO or Head of Operational Risk. These individuals are primarily responsible for promoting proper management of and measurement of the amount of operational risk across the organization. It is a firm?s Business Managers who control the resources that control operational risk.
Unfortunately, not enough Business Managers engage in formal operational risk strategies. As a result many firms face unnecessary threats to the successful achievement of their financial objectives.
This needs to be addressed. Today, global financial institutions face pressure to continuously tackle mounting regulatory change and growing market scrutiny while striving to increase customer confidence, drive competitive advantage, and optimize stakeholder value.
Paramount to their success is their Business Manager?s ability to accurately monitor internal processes and procedures to manage risks and business opportunities.
The Role of a Business Manager for Operational Risk
Business Managers play the most critical role in promoting a controlled risk culture. As a manager, they have an obligation to ensure that you and your staff are conducting business efficiently, honestly and fairly.
If your Business Manager does not keep this obligation, regulators can impose sanctions on the firm and individual staff members who have violated these requirements. Hefty damages, lost jobs and irreparable damage to the firm?s reputation may follow if you do not constantly pursue effective leadership and supervision.
Operational risk needs to be a priority in the management agenda. Business Managers have specific responsibilities that they must carry out in order to meet regulatory and fiduciary requirements.
A good operational risk methodology and management structure will promote appropriate behavior.
It is also important to understand that a management structure will need to complement the firm?s overall operational risk methodology. A good operational risk methodology should be collaboration between Operational Risk Managers and Business Managers to achieve well-considered risk assessments.
These assessments should be based on thorough research into all the risks which exist in each business unit, looking at the potential for a loss on a near term basis as well as a worst case basis.
This will also vary by organization as some may feel a more control based approach works for them, whilst others may believe examining risks and controls along processes is more in keeping with the way they consider things. This methodology will also likely include the usual questionnaires, scorecards, causal factors, etc.
How to Identify And Avoid Management Failure
Identifying and avoiding the potentially negative consequences of management failure or more importantly being a successful Business Manager takes a great deal of effort. One can considerably improve the chance of success by regularly reviewing the current management data and its structure and being knowledgeable about some of the common mistakes business managers make.
On a regular basis, Business Managers should examine and review their current management systems and execution, identify areas for improvement and make the necessary changes.
Critical to this review is the availability of timely, complete and reliable related data. Where in most cases the Risk Management team takes on responsibility for organizing, collecting and maintaining this data, it is the Business Managers who can extract real value from it.
Business Managers should be taking the lead in using this data to reduce losses by strengthening controls where necessary, perhaps stream-lining some processes after examination and consultation with internal audit.
More controls are not always the solution; simplifying processes can improve controls too in certain situations. In this activity, the Operational Risk Manager will prove an invaluable partner by doing nearly all the work leaving the Business Manager to do what they do best and that is make decisions based on recommendations.
There is usually a lot of data to be collected and kept up to date. In addition, this data needs to be analyzed and regularly reviewed. To maximize the benefits of this analysis, most mature financial firms should endeavor to rely on a unified computer system that gives flexibility to a manager to manipulate and analyze varied selections of related information.
This is very difficult to do when risk managers keep different Governance, Risk and Compliance information in spreadsheets or in different systems that were designed at different times with different architectures. This fragmented approach often produces data barriers across business units and leads to inefficient and costly maintenance and operations.
Firms that are able to readily access and use critical data across traditionally disparate business unit silos, will be able to increase their data integrity while more effectively quantifying, analyzing and measuring the effectiveness of their Governance, Risk and Compliance initiatives.
Having all this information in one, unified system that allows busy Business Managers to quickly see all the different types of risks and the state of controls in that part of the organization for which they are responsible enables them to make good decisions about whether changes are required.

SAN JOSE, Calif. (AP) ? Danell Leyva likes being right as much as he enjoys winning.
The world parallel bars champion has been saying for months there is not just one guy pushing him on the way to the London Olympics. And every competition, someone else comes along to back him up.
Leyva moved into the overall lead in the race for London on Thursday, but it was Sam Mikulak who won the first day of the Olympic trials. The 19-year-old who oozes California cool finished with 91.8 points, edging Leyva by a mere 0.1 points. John Orozco, who beat Leyva for the U.S. title earlier this month, was third.
"That's huge because I did a pretty good meet myself," Leyva said. "To know he had the highest all-around score today, that's awesome."
While individual prizes are nice, the Americans want that big shiny gold medal that goes to the best team. And for the first time since 1984, they just might have the goods to do it.
Leyva and Orozco remained in position to earn automatic spots on the five-man London squad, reserved for the top two all-arounders ? so long as they also rank among the top three in at least three of the six disciplines. At the moment, Orozco and Leyva both meet those criteria, with Mikulak closing fast.
Leyva has a total score of 276.500 going into Saturday's finals, followed by Orozco (275.550) and Mikulak (274.650). Jonathan Horton, a double Olympic medalist, is fourth, and Jake Dalton is fifth.
Chris Brooks, a former world team member, lost ground in his quest to get off the London bubble, falling on both vault and parallel bars. He is in sixth place, and is in the top five in only one event.
"I don't think anybody's out of it," Brooks said. "You've got to get your head back into the game and continue to fight."
Or, if you're Mikulak, keep doing what you're doing.
Mikulak has been one to watch since claiming the NCAA title as a freshman at Michigan. But he never had a shot at last year's world championships team after breaking both his ankles at a meet in Puerto Rico. His rehab set him back several months, and the legs remained so tender it wasn't until recently that coach Kurt Golder let his precocious star bust loose.
But look at him now. Cheered on by a raucous bunch of friends wearing "Team Sam" T-shirts ? complete with Mikulak's picture ? and moving around the arena with every event, Mikulak let everyone know from the start that he cannot be overlooked. His parallel bars routine was exquisite, filled with difficult skills and combinations but done with the precision of a Swiss watchmaker.
His handstands were so still he could have been a model for an art class, and when he hit the mat with an emphatic thump, the low-key Golder pumped his fists. His score of 15.7 included a 9.5 execution mark that would be matched by only one other person the rest of the day.
He had the crowd oohing and aahing with his acrobatic high bar routine, and he displayed cat-like reflexes on floor exercise. Looking as if he was about to go out of bounds on one of his tumbling passes, his toes almost seemed to pull back into his feet to keep him safely in bounds.
His only real "flaw" was on pommel horse, where he stalled before his dismount. But he managed to hang on, and walked off the podium with a grin.
"I was just able to zone everything out, breathe and keep control over all my skills," Mikulak said.
He was so in the zone he didn't even realize he'd finished ahead of Leyva and Orozco, the last two U.S. champions.
"What?" Mikulak said when Horton told him. "Seriously?"
"Kid's a gamer," Horton said. "He just knows how to perform. That's all there is to it. He just knows how to go out there and do his job."
Indeed, Mikulak was able to keep his cool while the high stakes seemed to get the best of his more seasoned competitors.
The dynamic Leyva was perhaps a little too amped up. Leading off on floor, he zipped through a sloppy set that included a step out of bounds, moving so quickly it appeared he'd chugged a fistful of Red Bulls during warmups.
Orozco, dubbed the "Silent Ninja" because of the way he sneaks up on the competition, stumbled a bit on pommel horse, stalling just before his dismount. Two events later he took a step back, literally on vault. He failed to get the proper height off the table and crouched while landing. His rear never hit the floor, but his hands did, and the 14.8 he received blunted his momentum.
"The only thing I would like to do is my best and show the committee I'm ready and ready to compete and represent the USA," Orozco said. "I think I didn't show enough of that tonight."
It was all the opening Leyva needed despite a somewhat ho-hum afternoon that lacked the "wow" factor that's made him perhaps the most charismatic gymnast of his generation.
But as Leyva has been telling everyone, there's plenty more where he came from.
"This is such a deep team and everybody is so good," Mikulak said. "This is such a deep USA team ... but if I keep hitting routines, and they see that I'm consistent and reliable, I think that's a good quality."
Many California consumers were thrilled with the U.S. Supreme Court decision Thursday to uphold the national health reform law, but a doctor's group cautioned that at least one problem lies ahead.
"This is a victory for consumers and especially for California," said Anthony Wright, executive director of Health Access California, a statewide consumer group. "No state in the nation had more at stake.
"This removes the cloud," he added. "There will be no more political speeches in the Legislature saying we should hold off on bills until the Supreme Court rules."
Also pleased were people who worried about losing consumer protections provided under the law, including Newark resident Shavon Walker. At age 37, she has diabetes, high blood pressure and other health problems. She has coverage through her husband's job but had feared that if she lost that, no insurers would accept her because of her medical condition.
Now beginning in 2014, she will no longer have to worry about that. The law will prohibit insurers from rejecting people because of pre-existing health conditions.
"My husband and I both are grateful for this," Walker said. "We'd rather pay a tax than an astronomically high bill in the emergency room."
Others took a more cautious approach, however. The California Medical Association, representing more than 35,000 physicians, described its reaction as "mixed."
CMA has vigorously supported the mandate that most
Americans have health insurance and other reforms, including requiring insurers to accept people regardless of pre-existing health problems.
But it noted that with as many as 3 million uninsured people expected to enter the Medi-Cal program when it is expanded in 2014, getting access to doctors will continue to be a problem. Because of low reimbursement rates, many doctors do not accept Medi-Cal patients.
Recent reports have found that 50 percent of Medi-Cal patients have difficulty finding a physician.
The Affordable Care Act "builds reform on the broken foundations of Medicare and Medicaid without addressing the underlying problems and inadequate funding," said CMA President James Hay. "CMA will continue to work to fix those ills."
Access to doctors may also be an issue for the thousands of children who will be moved into Medi-Cal with this week's decision by state lawmakers to cancel the Healthy Families program in a budget-cutting move.
Others said the Supreme Court's decision will benefit California financially by easing the burden of caring for the uninsured. They note that beginning in 2014, the state is expected to receive nearly $9 billion a year in federal funds to expand Medi-Cal.
"For our state, today's decision is both a fiscal blessing and a clear signal that there should be no more excuses," said Daniel Zingale, senior vice president of The California Endowment, a statewide health foundation. "Covering the uninsured currently costs our state nearly $10 billion per year and we need to continue to move full speed ahead to ensure that millions of Californians take advantage of the new options and consumer protections provided by the law."
The Supreme Court decision will enable California to continue moving aggressively to implement the law, including setting up a new insurance marketplace for consumers and expanding Medi-Cal in 2014.
The ruling saves programs and consumer protections affecting millions of Californians and will bring billions of dollars in additional federal revenue to the state.
California, with 7 million uninsured residents, has been at the forefront of states seeking to put the reforms in place.
California programs that will survive, to the relief of participants, include:
Low-Income Health Program: More than 400,000 low-income, mostly childless adults are receiving coverage through interim programs in 47 counties. These programs were set up in antieople are to be transferred to Medi-Cal when it expands in 2014.
Pre-Existing Condition Insurance Plan: Nearly 11,000 people are covered under this plan set up for those whose health problems make it difficult, if not impossible, to obtain insurance. This program, funded through the national health reform law, will last until 2014 when insurers can no longer reject people based on their medical condition.
California Health Benefit Exchange: The state plans to open a marketplace in 2014 where many consumers can choose a health plan and determine whether they qualify for subsidies. The state has hired staff and is making policy decisions to begin pre-enrolling people in October 2013.
Many consumers, meanwhile, were closely following what would happen with benefits they are receiving under the law.
These will now continue, including:
Help for seniors who hit a Medicare prescription drug coverage gap known as "the doughnut hole."
The elimination of lifetime caps on health insurance benefits.
Free annual wellness visits for Medicare recipients and free preventive services such as mammograms and colonoscopies.
Insurance company rebates. These are required when insurers fail to spend at least 80 percent of premiums on medical care and quality improvement, rather than salaries and other administrative costs. Nearly 1.9 million Californians will receive $73.9 million in rebates this summer, averaging $65 per family.
A requirement that beginning in 2014, insurers accept all people, regardless of pre-existing health problems.
Young adults will be able to remain on their parents' health insurance policies up to age 26.
Insurers can no longer reject children under 18 because of their health problems.
New health insurance policies must cover maternity services beginning Sunday.
Insurers can no longer cancel people's coverage when they become ill because of unintentional misrepresentations on their applications.

HOUSTON (AP) ? Texas Gov. Rick Perry has spent much of the past three years loudly and defiantly fighting against what he views as Washington meddling in state affairs, often refusing to cooperate with the U.S. Environmental Protection Agency and becoming a leader in the battle against President Barack Obama's health care plan.
Other Republican governors pursuing a similar tactic may want to take note of what's happened in Texas amid Perry's hard-fought battle: An obstinate refusal to cooperate has resulted in more, not less, federal oversight.
"We're very conservative and we're very stubborn," said Bill Miller, a lobbyist in Austin for HillCo who has represented both Republicans and Democrats. He described the Texas mindset this way: "We're not going to be smart. We're going to be pure. It's a point of pride and if there's something else we're proud of, it's our pride."
One area where Texas has fought ferociously with the feds has been on environmental regulations. Yet as the state challenged EPA rules in court over the past three years, the federal agency simply side-stepped the state to work directly with industry.
A similar scenario is playing out with Obama's health care overhaul in Texas, where nearly a quarter of the population, or 6.2 million people, are uninsured. Now that the U.S. Supreme Court has given the law the green light, it's highly likely that Texas won't have time to build a key program, forcing the federal government to design and manage it until the Lone Star State steps up.
"When Texas maintains programs ... they're able to allow Texas values to predominate," said Cal Jillson, a political scientist with Southern Methodist University in Dallas.
And when the federal government steps in, it actually strengthens the anti-Washington sentiment in Texas.
"Typically, federal involvement in Texas drives the argument that it's no damn good for Texas," Miller said.
Richard Hyde, deputy executive director of the Texas Commission on Environmental Quality, has been dealing with such issues for several years. First, the EPA overturned a long-standing air-permitting program, forcing more than 120 plants to get new operating papers. As Texas pursued court challenges, the EPA worked with the companies, ensuring that some of the nation's largest refineries could operate.
Then, when Texas refused to participate in a new requirement that companies that emit greenhouse gases get special permits, saying it does not have the authority to issue such paperwork, the EPA began directly administering the program, Hyde said. The agencies do communicate "about process" because the EPA is not usually in the business of issuing permits, he said, but the situation is not ideal.
"With greenhouse gas permitting and flexible permits, certainly they felt like we should fit in a box just like all the other 50 states. And if you want to ... think out of the box and it doesn't fit in the mold, it doesn't work for them," Hyde said. "We want to show that the Texas way works for Texas."
When it comes to Obama's health care plan, Texas has focused on challenging the law in court. That means it's unlikely to have a health insurance marketplace up and running by 2014. The insurance exchange is designed to allow individuals and small businesses to shop for coverage from a range of competing insurers.
As a result, Texas and other GOP-led states that counted on the law being overturned could see Washington running their exchanges instead.
Mark Jones, the head of the political science department at Rice University in Houston, points out that when the Texas Commission on Environmental Quality oversees a permitting program, it considers industry needs and the economy first, while the EPA emphasizes the environment ? two conflicting philosophies. With the health care exchange, Jones believes that because the government acts as a clearinghouse, federal involvement will not have as much impact.
Still, he said, if Washington puts together Texas' exchange it will almost certainly be "more progressive and liberal."
Faced with that possibility, some Republican governors hedged their bets. In Michigan, for example, Republican Gov. Rick Snyder indicated before Thursday's ruling that he would consider moving forward with his state's exchange so it could control its design. He said he was "just trying to be a pragmatist."
Perry declined Thursday to say whether he would ask lawmakers to create an exchange or move forward with implementation.
The U.S. Department of Health and Human Services is already running a federally mandated insurance plan that has about 5,700 Texans with pre-existing conditions participating, a transitional program that will be available until the exchange is in place. Other states have asked to run this program themselves.
Arlene Wohlgemuth, executive director of Texas Public Policy Foundation, a conservative think tank in Austin that includes health care as a focus, said there doesn't appear to be much of an advantage to Texas running its own exchange program because the law doesn't give states much room to tailor the programs.
"There was so precious little flexibility allowed that it really doesn't matter," she said. "We never saw any advantage in having a state do their own health care exchange."
